1. Who this is between

This agreement is between Leveraged Digital ("we", "us"), which provides Leveraged IDX, and the brokerage or agent who orders it ("you"). The person who places the order confirms they can bind the brokerage or business named on the order.

2. What you get

Leveraged IDX is a subscription service that shows MLS listings on your website through an embed or a hosted search site, captures leads, and sends them to you. Features depend on the plan you choose: Basic, Pro, or Premium, as described on our pricing page at the time you order.

3. Your MLS

We can only show listings from an MLS that has approved the data feed for your brokerage. You agree to sign the MLS's IDX license paperwork and to follow its rules. Approval times are set by each MLS, and we don't control them. We start your MLS paperwork after you order and keep you updated.

If your MLS is not live with us yet, you can still order. Your plan fees start when you order so that setup work can begin.

4. Fees and billing

• Plan fees are billed monthly or annually, in advance, to the card you give Stripe. Annual billing is ten times the monthly price.
• Setup fees are one-time. During our introductory offer, setup fees are waived.
• If your MLS or association charges an IDX data fee, it is passed through to you at cost, with no markup. The amount is set by your MLS or association. We tell you the amount before the first charge.
• Prices can change with 30 days' written notice. A change applies from your next billing period.
• If a payment fails, Stripe retries it. If it still fails after 14 days, we may pause your search until it is paid.

5. Refunds

• MLS not approved: if your MLS has not approved your feed within 90 days of your order, and the delay is not caused by missing paperwork from you, you can cancel and get a full refund of the plan fees and setup fees you paid.
• First 30 days: if you cancel within 30 days of your listings first going live, we refund that month's plan fee.
• After that, fees already paid are not refunded, but you can cancel any time and keep the service until the end of the period you paid for.
• MLS pass-through fees are refundable only if the MLS refunds them to us.

6. Cancelling

You can cancel any time by emailing info@leverageddigital.com. Cancellation takes effect at the end of your current billing period. We may end the service for nonpayment, for breaking your MLS's rules, or for misuse, with notice where we can give it.

7. Your leads and data

Leads captured through your search belong to you. We never sell them and never show other agents' ads on your search. We keep your data only to run the service, and you can ask us to export or delete it when you leave, subject to records we must keep by law or MLS rules.

8. Listings and accuracy

Listing data comes from your MLS and is shown under the MLS's IDX rules, including required notices. It is deemed reliable but not guaranteed. We are not responsible for errors in MLS data.

9. Limits of responsibility

We work to keep the service available and correct, but it is provided as is. To the extent the law allows, our total responsibility for any claim is limited to the fees you paid us in the 12 months before the claim, and we are not responsible for lost profits or indirect damages.

10. General

This agreement is governed by the laws of the State of Oregon. If part of it can't be enforced, the rest still applies. We may update this agreement with 30 days' notice. Questions: info@leverageddigital.com, +1 503 694 7020.
